I Was Recently Interviewed At My Local McDonald's and I Was Told That To Get Hired, I Would Have To Cut My Hair. When I Asked If I Could Just Pull It Back Into A Pony Tail, I Was Told I Could Not Do So. However, They Allow Female Employees To do So. In Addition, There Are Female Employees Working There With Hair Around The Same Length As Mine (a little longer) and They Do Not Even Have To Put their Hair up Or Anything!



Would This Be Considered Discrimination?

Cur it or find a job that doesn't care.

That is a good question. Employers are free to discriminate on any basis that does not involve one of the 7 prohibited categories. Courts are mixed on this issue. In the absence of any definitive Supreme Court cases, the lower courts interpreting state laws are controlling.



In Texas, discrimination against males with long hair has been ruled constitutional. One school of thought is that Long hair worn as a form of political expression may be protected free speech. A string of cases supports the view that if the hair has religious significance, as in the case of American Indians or Sikhs, it is protected as religious freedom. There is no definitive ruling that says this can be discrimination on the basis of sex, even if the rules are different for men and women.



Here is a listing of cases involving student dress-codes compiled by Wisconsin's ACLU. If you do not have a strong case, you are probably going to have to cut your hair or work at a place that does not care.

Dress codes are a touchy subject. The bottom line is McDonald's has created an image and that image does not include men with long hair. It's going to be tough to beat this one.

Yes. My guess is that it's discriminatory. If a woman can wear her hair in a ponytail then a male employee should be able to do the same.



However, they would probably argue it's a matter of dress code, but I don't think it's a valid argument.

Go get a job in a coffee shop instead. The work is more pleasant and they probably will not care about the long hair.

well girls would look nasty with short hair but i had the same problem at burger king so i cut it and spike it in the front and now girls come over to me and start talking u might want to cut it girls like my hair they might like Ur's cut to (';')/

No, "long haired men" is not a protected class as far as discrimination goes.



You'll need to cut your hair to take that job. Of you could find a different job.



Just a hint ... most workplaces have similar dress codes!

yes its discrimination each mcdonalds franchise is independently owned and operated. the ones around here they dont care if a guy has a mohawk long hair earrings etc. they just want you clean and ready for work (i live in ohio)



im sorry to hear you are having problems i would look into speaking with one of those attorneys that have free consultation and see what they think you can do about it (look in the phonebook yellow pages and some will say free consultation or you dont pay unless we win)
